Introduction. This Privacy Policy (the “Policy”) explains how Gently Inc., a Delaware corporation dba Gently Soap (“Gently”, “we”, “our”) collects, uses, and discloses personal information through its website, mobile website, social media site, software, email exchange of information, and any other digital platform, including any services, features, pages, and functions contained or offered therein, including any transactions, orders, sales, purchases, or the acquisition of goods or products (the “Services”). By using or accessing the website or Services in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, and you hereby consent that we will collect, use, and share your personal information in the following ways. Any capitalized terms that are not defined in this Policy are defined in our Terms of Use.

Information Collected And How We Use It. As explained further in this section, you will have the opportunity to provide us with certain personal information. In addition, we may collect certain personal information automatically through your use of the Services. We will use this information to provide you with the functionality of our Services, to improve our Services, and to provide you with information about our Services. The rest of this section provides a more detailed explanation of the personal information we collect and how we use that personal information.

Voluntarily Disclosed Information.

Account Creation. If you create an account, you will need to provide your name, email address, and you may provide a photo if you choose. You will also be required to choose a password. As part of the account creation process, you may also be able to provide us with access to additional personal information and data through integrations with third-party services like Facebook, Google, and Instagram.

Product Purchases. When you purchase our products, you will need to submit personal information including your name, home address, email address, and phone number. This information is necessary for us to send you the products you order. In addition, you will be asked to provide certain financial information so that you can be charged for those products. Please note that your financial information will be collected and processed directly by the Shopify platform, as explained further in Section 3.2 (Shopify Platform). We will not have access to your financial information.

Posts and Comments. You will have the option to post content and text in your use of the Services (collectively, “User Content”).

Gently Communications. We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address or phone number, we may send you promotional email and/or text offers or email and/or texts you about your account and your use of the Services.

Marketing Recipient. If you are interested in learning more about our Services, you may subscribe to promotional emails from us via our website. In order to subscribe, you will be asked to provide your name and email address. If you are not otherwise a user of our Services, we will only use your personal information to send marketing communications and our newsletter relating to products and services that we offer.

Automatically Collected Information.

Browser & Device Information. Whenever you interact with the Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” and pixel tag information, the type of device you’re using to access the Services, the amount of time spent on the Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in the Services are visited and by how many people. “Pixel tags” are tiny graphic images with a unique identifier, similar in function to cookies, that are used to track online movements of web users. In contrast to cookies, which are stored on a computer hard drive, pixel tags are embedded invisibly in web pages. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies and pixel tags, but this may prevent you from taking advantage of some of our features. We use the data we automatically collect from you to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve the Services – for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Emails. We may receive a confirmation when you open an email from us.

Disclosure Of Information. We may disclose your personal information to the categories of third parties identified in this section.

Personnel and Third-Party Service Providers. We employ personnel and engage other companies and people to perform tasks on our behalf and need to share your personal information with them to provide products or services to you. For example, we use a third-party payment processor to process payments on our behalf.

Shopify Platform. Our website and payment processing runs through the Shopify platform. You can learn about Shopify’s information collection and use practices at the following website: https://www.shopify.com/legal/privacy/customers.

Other Users. Please note that if you submit any personal information or User Content that is accessible by other users, including an online forum or comment section, those users will be able to see that personal information and User Content. Accordingly, only include personal information in such submissions that you are comfortable sharing with other users.

Third Party Applications. If you use third party applications (the “Third-Party Apps”) through the Services, Gently will allow the providers of those Third-Party Apps (the “Third Party Providers”) to access or use your personal information and User Content as required for the interoperation of the Third-Party Apps and the Services. Any Third-Party Provider’s use of your personal information and User Content is subject to the applicable agreement between you and the Third-Party Provider. Gently is not responsible for any access to or use of your personal information or User Content by Third-Party Providers. You are solely responsible for the decision to permit any Third-Party Provider to use your personal information or User Content.

1. Facebook Marketing. Through a pixel tag placed on our website, we may measure, optimize and build audiences for our advertising campaigns on Facebook. In particular, we will be able to see how our users move between devices when accessing our website and Facebook, to ensure that our Facebook advertising is seen by our users most likely to be interested in such advertising by analyzing which content a user has viewed and interacted with on the website. Your email address may be shared with Facebook as part of this functionality, but it will be “hashed” in your browser so that it is not viewable by Facebook.

2. Analytics Services. We use Google Analytics to understand how visitors engage with our Services. You can learn more about the information that Google has access to at the following website: https://policies.google.com/technologies/partner-sites.

Anonymous Information. We may de-identify your personal information so that you are not identified as an individual, and share that information with third parties. We may also provide aggregate usage information to third parties (or allow these third parties to collect aggregate information of activity on our Services), who may use that information to understand how often and in what ways people use our Services, so that they, too, can provide our users with an optimal online experience.

Business Transfers. If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal information could be one of the assets transferred to or acquired by a third party.

Legal Compliance. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with governmental requests, law enforcement or court orders, or enforce or apply our Terms of Use and other agreements.

California Residents. If you reside in California, you have the right to ask us one time each year if we have shared personal information with third parties for their direct marketing purposes. Indicate in your letter that you are a California resident making a “Shine the Light” inquiry.

Security. We use commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. In addition, we enter into contracts with all of our third-party service providers that require reasonable precautions be taken against unauthorized uses of your personal information. We cannot, however, ensure or warrant that these precautions will always be successful or that your personal information on the Services may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We are not responsible to our users or to any third party due to any such loss, misuse, or alteration.

Modification, Deletion & Retention Of Information. Through your account settings, you may access, edit and delete your profile information. Please understand, however, that it may be impossible to delete this information completely, due to backups and records of deletions. In addition, we may deny a deletion request if (i) the denial is necessary for us to comply with applicable law, or (ii) the request pertains to content that you posted on a publicly available portion of the Services and that cannot be deleted without impacting the Services experience for other users. You may not request the removal of de-identified, anonymous, or aggregate data from our databases. Subject to your right to request deletion of your personal information, we will retain your personal information as long as needed for your use of the Services, your approved receipt of marketing communications from us, our compliance with legal obligations, and to protect our or other’s interests.

How We Respond To Do Not Track Signals. We do not track you or collect your information across third party websites or online services. Thus, we do not receive Do-Not-Track signals, or other similar signals. To the extent that we do receive any such signals, we will not comply with them as it is not an aspect of the functionality of the Services.

Age Of Users. Children under the age of 13 are not permitted to use, access or register for the Services in any way. We do not knowingly collect or solicit information from anyone under the age of 13. If we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible.

Changes To Policy. We’re constantly trying to improve the Services, so we may need to change this Policy from time to time as well. The date of the last modification will be posted at the beginning of this Policy. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by the modified Policy.
